LINDOR is going to assist six winners in planning, executing and capturing on camera the perfect wedding proposal, to the value of R20 000 per proposal. LINDOR could give you the chance to propose in style – perhaps in a hot air balloon, or a sunset yacht cruise, a vintage car ride or a romantic beach picnic assembled by a renowned chef?

The videos of these perfect proposals will be uploaded to YouTube and Lindt’s Facebook page, where the public will have the opportunity to watch the six proposals and vote for their favourite proposal and couple.

The winning proposal – that’s the one with the most public likes – will win an all-expenses-paid, five-star luxury honeymoon of their dreams.

All six perfect proposal finalists will also win a LINDOR wedding cake made by the LINDT Chocolate Studio, as well as 500 LINDOR Truffles for their wedding.

LINDT TERMS AND CONDITIONS

1

DEFINITIONS

1.1

“you

”, “your

”, or “entrant

” means the person who has entered the Competition;

1.2 

“we

, “us

”, “our

” means Lindt & Sprüngli (South Africa) Proprietary Limited, including  our holding company;

1.3 

“Agency

” means Bletchley Park Creative Marketing Agency, an agent of Lindt & Sprüngli (South Africa) Proprietary Limited, with its principal place of business at Units G1 and G2, Victoria Junction, Entrance 5, Prestwich Street , Green Point, Cape Town, with e-mail and facsimile correspondence to be addressed to Jess Webb at [email protected] and 021 427 1310, respectively;

1.4 

“Competition

” means the chance to win the Prizes, by entering the LINDOR Valentine’s Day competition 2014 via one of six different online media platforms, comprising Ndalo Media – Destiny Connect and Destiny Man, Media24 – Grazia, Media24 – Food24, Media24 –Huisgenoot, Conde Nast Independent Magazine – Glamour and Independent Online – IOL (“Cooperation Partners

”)

1.5 

“‘LINDOR perfect wedding proposal’

” or the “proposal ‘event’

” means the event of a person proposing marriage to another, sponsored by us;

1.6 

“the Rules

” means the rules of the Competition as set out herein;

1.7 

“the Prize

“, which is to be awarded to six different winners, includes –

1.7.1

the planning, and execution of a “LINDOR perfect wedding proposal” to the value of a maximum of R20 000 (including VAT) each;

1.7.2

the shooting and production of a 1-3 minute video of the “LINDOR perfect wedding proposal”;

1.7.3

a LINDOR wedding cake made by the LINDT Chocolate Studio as well as 500 LINDOR Truffles for each winner’s wedding or any other ceremony formalizing the couple’s union (“wedding”), provided that the wedding takes place pursuant to the “LINDOR perfect wedding proposal”.

1.8 

“the Grand Prize

“, to be awarded to  only one final winning couple, includes an all-expenses-paid honeymoon to either a 4- or 5-star hotel in Mauritius or to a 4- or 5-star hotel in South Africa up to a maximum value of R 30 000 (including VAT) for two persons. We will propose one package for each of the two destinations consisting of –

1.8.1

flights to and from the chosen destination, and one transfer to the hotel destination and from the destination airport only; and

1.8.2

accommodation for a minimum of 7 nights in either the Mauritius hotel or the South African hotel. The Grand Prize winner has a 12-month period from 14 February 2015 to redeem the Grand Prize.  The Grand Prize may only be redeemed upon presentation of actual proof of the wedding, such as a valid certificate or affidavit signed by the Grand Prize winner, failing which the Grand Prize winner is deemed to have declined the Grand Prize.

1.9 

“Prizes

” means collectively the Prize and the Grand Prize, which exclude –

1.9.1

engagement and wedding rings or similar jewelry or any other personal gifts for the winners or any other person;

1.9.2

costumes, dresses and suits;

1.9.3

hair and makeup;

1.9.4

any flights and transfers in addition to those awarded as part of the Grand Prize;

1.9.5

the costs of obtaining passports, visas, and any innoculations or vaccinations;

1.9.6

excess baggage allowance;

1.9.7

any food and beverages that are not included in the Grand Prize hotel package;

1.9.8

any excursions, sporting activities, tours or trips that are not included in the Grand Prize hotel package;

1.9.9

any loss of whatsoever nature caused by a delayed, changed or a cancelled flight. The winner/s agree to deal directly with the respective airline or travel agency regarding any compensation or similar claims of this nature;

1.9.10

any and all costs exceeding the value of the Prizes, which arise due to the preferred travelling dates chosen by the winner/s. 

1.10 

The Prizes are non-transferable and will only be awarded if all the details supplied by the entrants are factually correct.

1.11 

The Prizes may not be exchanged for cash amounts and may only be substituted with another Prize of similar commercial value, as selected in our sole and exclusive discretion, if, for any reason beyond our reasonable control, any of the Prizes is not available.

RULES

This Competition is subject to the Rules.  All entrants, by entering the Competition, agree to be bound by the Rules.  A copy of the Rules is also available at www.Facebook.com/LindtChocolateSA.

2.1 

You must read the Rules and pay special attention to all the terms printed in bold.  

2.2 

In order to qualify as an entrant, you must –

2.2.1

reside in the Republic of South Africa;

2.2.2

have a valid South African passport and ensure that your prospective partner also has a valid South African passport;

2.2.3

be over the age of 18 years;

2.2.4

intend in good faith to propose marriage in January 2015;

2.2.5

submit your entry, between 00:01 on 11 November 2014 and midnight on 30 November 2014 (“the Closing Date

“), via one or more of the Cooperation Partner’s websites, which may be accessed at; http://www.destinyconnect.com/, http://www.destinyman.com/,http://www.graziadaily.co.za/,http://www.food24.com/,http://www.food24.com/, https://www.glamour.co.za/ andhttp://www.iol.co.za/the-star. Your entry must comprise the following

2.2.5.1

an uploaded picture of yourself and your significant other;

2.2.5.2

a description, in up to 300 words, of how you would plan your “LINDOR perfect wedding proposal”;

2.2.5.3

a completed contact form with your full name, address and phone number;

2.2.5.4

acceptance of the terms and conditions of the Competition.

2.3

All entries must be received by the Closing Date. Any entries received after the Closing Date, or that does not comply with these Rules, will be invalid and will not be considered, nor will we or Cooperation Partners have any obligation with respect to the entrant.  

2.4

Entrants do not have to pay anything to participate in the Competition.  If the entry is posted or sent using the internet, short message service (SMS), multimedia messaging service (MMS) or any similar media or device, the entrant will have to pay the reasonable costs of posting the entry form or of transmitting.  This cost will not be more than the normal fee the entrant will pay to his/her service provider or for using the internet.

2.5

The six Cooperation Partners will each put forward three entries, based on their choice of the best plans for a “LINDOR perfect wedding proposal”.  The creativity and feasibility of the proposal, within the prescribed budget and subject to our shooting requirements, will be used as criteria to determine the best plans for a “LINDOR perfect wedding proposal”.  We will then choose one winner from each of the Cooperation Partners’ entries as the best plan for a “LINDOR perfect wedding proposal”. These six winners will win their “LINDOR Perfect wedding proposal”, as arranged by us.  This LINDOR Perfect wedding proposal which will be filmed by us and posted onto Youtube.com allowing the public to vote for the final couple who will win the Grand Prize. Each of the “LINDOR Perfect wedding proposal” six winners will win a LINDOR wedding cake made by the LINDT Chocolate Studio and 500 LINDOR truffles for their wedding.

2.6

The six winners will be contacted telephonically by us and/or the Agency in the first two weeks of December 2014 to confirm the proposal plan with the winner and to plan the proposal.  If a selected winner does not answer his/her landline and/or mobile phone, we and/or the Agency will leave a message on the winner’s landline or mobile phone (if possible).  We undertake to try at least three (3) times on three (3) consecutive days to notify the winner/s telephonically.  If we cannot get hold of the winner telephonically or cannot leave a message telephonically, we will send a notice to the contact details (i.e via sms, e-mail or post) provided by the entrant.

2.7

The six winners must be willing to propose on one of the following weekends and in one of the following locations: 10 – 11 January 2015 in Durban, 17 – 18 January 2015 in Johannesburg and 24 – 25 January 2015 in Cape Town.

2.8

If a winner is not available for whatever reason on the selected dates we have the right to choose another winner.

2.9

Any and all decisions made by us, the Agency and the Cooperation Partners are final and no correspondence will be entered into concerning these decisions.

2.10

The six proposal ‘events’ will be planned by us and/or the Agency in collaboration with the winners.

2.11

All proposal ‘event’ details, including timings and shoot details must be finalized and agreed in writing by 19 December 2014, failing which we have the right to choose another winner.

2.12

Winners must sign written agreements and adhere to timings set for proposal ‘events’.  Once the proposal ‘event’ has taken place, the intended partner of the winner must similarly sign written agreements concerning the proposal ‘event’. If either or both the winner and/or the intended partner of the winner does/do not sign the written agreements the winner is deemed to forfeit the Grand Prize and the video of the winner’s “LINDOR perfect wedding proposal” will not be published.

2.13

Written agreements will also include rights of usage and privacy considerations of the 1-3 minute videos produced for each of the proposal ‘events’.

2.14

The six winners will be announced on our Facebook page and each of the Cooperation Partners’ websites on 5 February 2015 when the proposal videos are put online.

2.15

The Grand Prize winner will be voted for by the public and will be determined by the Youtube proposal video that receives the most “likes”.

2.17 Public voting will commence on 5 February 2015 until midnight on 13 February 2015.  All six videos will be uploaded to the LINDT YouTube channel. All voting will take place via the LINDT South Africa Facebook platform and users will be encouraged to ‘Like’ each post, with each ‘Like’ counting as one vote. No votes via YouTube or any other channels will be considered legitimate entries, but participants and platforms are free to promote their videos..The various platforms will be given the link to the relevant video, which they will be allowed to embed within their own site

2.16

Only 1 out of the 6 winners of the “LINDOR Perfect wedding proposal” will win the Grand Prize.

2.17

The Grand Prize winner will be announced on our Facebook page and on each of the Cooperation Partners’ websites on 14 February 2015.

2.18

The Rules may be amended by reasonable notification at any time during the Competition, and the amended Rules will be applied and interpreted at our sole discretion.

2.19

Such altered Rules and/or substituted prizes shall become effective immediately after being altered or on such date as may be determined by us.

2.20

No entrants shall have any recourse against us as a result of the alterations of the Rules or Prizes before the end of the Competition.

2.21

Each winner of a Prize is responsible to provide us with the relevant contact details to issue the Prize.

2.22

Winners agree to communicate their wedding date in writing to the Agency, at [Units G1 and G2, Victoria Junction, Entrance 5, Prestwich Street , Green Point, Cape Town], by 31 March 2015 at the latest, and collect their wedding cake and the 500 LINDOR truffles at the LINDT Studio in either Johannesburg (situated at the Design Quarter, Corner William Nicol & Leslie Ave, Fourways, Sandton) or in Cape Town (situated at the Cape Quarter, 27 Somerset Road, Green Point, Cape Town) before their wedding. The Prize winner has a 12-month period, from 31 March 2015, to redeem the Prize.  In order to redeem the Prize, Prize winners must provide us with reasonable proof that their wedding to the person proposed to in their “LINDOR perfect wedding proposal” will take place on the wedding date communicated to the Agency, failing which the winner in question shall be deemed to forfeit the Prize.

2.23

Any winner that does not redeem any of the Prizes awarded to him or her within the time frame prescribed by us or, where no time frame is prescribed, within 90 days of being notified of winning, will be deemed not to accept the Prize/s and we reserve the right to award the Prize/s to another entrant

2.24

We bear no responsibility for any delayed nullification, change or substitution, or partial or total inability to execute any of the obligations deriving from the conditions of the proposal ‘event’ in respect of the winners due to force majeure, including war, acts of terrorism, accident, fire, flood or any other natural disaster, strike or any other political crisis. 

2.25

We bear no responsibility with regard to the quality, appropriateness and/or use of the Prizes. 

2.26

In the event that any dispute should arise regarding the Competition, it will be settled by an appropriate South African court.

2.27

In the event that any part of these Rules is deemed by a court of competent jurisdiction or by any authorised authority to be invalid, illegal or unnecessary, then that relevant part only will not be applied and will be considered invalid while the balance of the Rules will continue to be valid and in force to the greatest allowable degree by law.

2.28

All the personal information that will be given during the period of participation in the Competition will be protected in accordance with South African law and our Privacy Policy which is available at http://www.chocolate.lindt.com/help/privacy-policy.

2.29

We shall keep all entrants’ personal information safe and confidential.

2.30

We shall not keep or use any entrant’s personal information for any purpose other than the Competition.

2.31

We shall not sell or transfer your personal information to any third party, except to our affiliates or agents, without your express consent.

2.32

By submitting your data when entering the Competition, you give your consent to us as the responsible party(ies) to collect and process your personal data for the purposes of the Competition.

2.33

We, our directors, members, partners, agents, consultants or employees, the suppliers of any goods and services in connection with the Competition and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this Competition. We reserve the right to verify the eligibility of all entrants.

3

RIGHTS

3.1

We have full rights concerning the use of the films of the proposal ‘events’ and pictures of the set and making of the films on all media channels (online, TV, social Media, POS, Internet, PR, Events, Lindt internally) in South Africa and Worldwide in 2015 and 2016.

3.2

Winners or any other participants that take part in any of the proposal ‘event’ films will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be our sole property. 

3.3

We are not liable if the filming of the proposal ‘events’ cannot take place for whatever reason or if filming material is lost or destroyed for whatever reason. There is no entitlement to the Grand Prize for any reason whatsoever.

3.4

We reserve the right to extend, shorten or suspend the time period of the Competition or to nullify it whenever we should so choose for technical, commercial, or operation reasons, or for the greater public good, or due to a “force majeure” or a decision made by a FMCG (“Fast Moving Consumer Goods”) company, or other carrier or authority that orders the suspension of the operation, or generally for any reason of comparable magnitude.  In these circumstances, we shall endeavor to notify the entrants or winners, as the case may be, as soon as reasonably possible.

4

OUR ROLE AND RESPONSIBILITY 

To the extent legally permissible and unless we acted with gross negligence or fraudulent intent –

4.1

we assume no liability whatsoever for any direct or indirect loss or damage arising from, in connection with or as a result of an entrant’s or Prize winner’s participation in the Competition; and 

4.2

entrants and the prize winners indemnify us against any claims of any nature arising from, in connection with or as a result of their participation, in any way whatsoever, in the Competition.
